What happens at a Trial?

If you do not reach an agreement at the Pretrial Conference, your case will be scheduled for a Trial.  A Trial Notice will be mailed to you.

 

You have the right to be represented by an attorney or you may go ahead without one.  If you want an attorney, you must retain one at your own expense.  The Court will not provide you with an attorney.

 

If you choose not to retain an attorney, you are solely responsible for your own defense.  This means you must prepare your own case and subpoena any witnesses to appear on your behalf.  Witnesses must come to the Court and testify.  Affidavits or written statements from witnesses are not allowed.  For every witness called, both you and the Village/Town Attorney will have a chance to ask questions.  After the Judge has heard all the evidence, he will make a decision.

 

Can I appeal?

Yes.  The Judge will explain your options at the trial.
