Purpose of Board of Review

Each municipality in the State of Wisconsin has the legal authority to create a Board of Review.  The Town of Somers has established a Board of Review, Town of Somers Ordinance 1.16 Board of Review for the purpose of :

  • Adjusting assessments when they have been proven incorrect by sworn oral testimony
  • Correcting any errors or omissions in the descriptions or computations found on the assessment roll
  • Checking assessment roll for omitted property and double assessments

Authority of Board of Review

Statute and case law define the authority of Boards of Review.  The following statements describe Board of Review authority.

  • Boards of Review are legally bound to accept the assessor's assessment as correct unless there is evidence that proves the assessment to be incorrect.
  • Boards of Review are not to assess property.  Their duty is to hear sworn, oral testimony about assessed values and based solely on that testimony to decide whether an individual has proven the assessment to be incorrect.
  • Boards of Review do not have the authority to exempt or not exempt property from taxation.

Sections 70.46 through 70.48, Wis. Stats. describe the authority, structure, and procedures for Boards of Review.

Help for Property Owners

For Wisconsin property owners who want to appeal their property assessments, the first formal step in the appeal process starts at the Board of Review.  Before property owners can appeal further, they must first appeal to the Board of Review.

How to Appeal to the Board of Review

Instructions on how to appeal to the Board of Review will be included in the original Notice of Assessment, as well as on the notice of the Open Book informal review determination.
